It's Been A Few Bad Weeks For Democracy, Because Democrats No Longer Believe In It.
In a twist of irony, the Democrat Party might well prevail in the 2024 Election cycle campaigning to save "democracy" while simultaneously working to stifle it.
In the past couple of weeks, three seemingly unrelated stories demonstrated conclusively that the current Democrat Party no longer believe in democracy. This would be alarming enough, but it is terrifying considering the same Party plainly intends to run in 2024 on a platform of saving that which it is working to end. Even worse, it might work.
The first clue came on December 1, 2023 when the Republican controlled House voted to expel George Santos. We had predicted this outcome almost a year ago to the day and sadly it has come to pass. Essentially, Santos election was overturned without a conviction and based on conduct that occurred before he was sworn into office. Save three expulsions for those joining the Confederacy during the Civil War, this is the first time in United States history that a Congressperson have been expelled without a conviction and only the sixth in our history. For Santos, an indictment and a bad House ethics report was sufficient to disregard the will of his district less than a year from the next election.
Candidly, the prior standard of conviction of by a jury of your peers likely was not Constitutional when it concerned conduct prior to an election. That subject is beyond the scope of this article. For current purposes, note that the precedent now has been set that supposed sloppy bookkeeping or potential misuse of campaign funds for personal use, when combined with a relentless Media narrative is sufficient to reverse the vote for a Congressional district.
Considering that almost any member’s finances might contain mistakes and certainly every member personally benefits from campaign proceeds in some form or another, whether the vote of the people will be sustained depends on whether you can obtain a negative House ethics report and a DOJ indictment. In other words, you no longer need to both with the pesky People via jury trial. You can call this system whatever you like, but removing the People of the district from the decision entirely is not democracy. Indeed, it was the respect for democracy that made prior House’s wait for a jury conviction.
Sadly, all but 4 Democrats in the House voted to overturn Santos’ election (2 voted “no,” while 2 voted “present”). Almost half of the Republican caucus also no longer respect the will of the voters. To be fair, many of them likely were caught up in the Media firestorm that had surrounded Santos almost from the moment he was elected. Again, the subject of the GOP going along with unconstitutional narratives must be left for a future editorial.
In seemingly unrelated news, John Kerry was speaking at an event yesterday evening on the sidelines of the U.N. COP28 climate talks in Dubai, where the nations of the world are negotiating a draft of a pledge to end fossil fuel use due to “climate change.” You might be wondering what position John Kerry occupies in the Federal government. Well, on January 20, 2021, he was sworn in as our nation’s first Special Presidential Envoy for Climate and the first-ever Principal to sit on the National Security Council entirely dedicated to climate change. The date of January 20, 2021 should strike you as odd because the Senate could not possibly have approved Kerry’s appointed to a basically cabinet level position on the same day Biden was sworn in as President. He did not have to because Biden created the position out of whole cloth. As a result, Kerry trots around the globe, with all the trappings of a cabinet level official, all with needing Senate approval or Congressional budgetary blessing.
Yet another example of today’s Democrat Party sidestepping the democratic process. In this instance not completely, since Biden did have to get “elected.” Otherwise the newly created office (and many others like it) do not resemble the system of governance established by the Founders. This will only proceed in one direction, which certain will not be towards democracy.
The third seemingly unrelated event occurred on Wednesday, December 6, 2023 in front of the Colorado Supreme Court. There, the court heard oral arguments on a case filed to keep Trump off of the ballot via the Fourteenth Amendment to the Constitution. Section 3 of the Fourteenth Amendment contains a disqualification clause for anyone that “shall have engaged in insurrection or rebellion against the [Constitution], or given aid or comfort to the enemies thereof.”
We have written about this clause before and explained that it does not apply to the office of the President. In fact, the lower court judge in Colorado agree with my analysis and held that while Trump “clearly engaged in an insurrection,” the office of the President was not included in those offices excluded.
However, even if the office of the President had not been excluded from the Fourteenth Amendment’s disqualification clause, it plainly is not democratic to seek to remove a candidate from the ballot. This is especially true considering there is any doubt about the disqualification clause’s application. The doubt is tremendous. Although the Democrat “scholarly law” lie machine has been in high gear suggesting otherwise, the clause’s plain language is not the only reason it has no application today. Among others, January 6 was not an “insurrection or rebellion.” Moreover, Congress has voted more than once to remove the disability, as the Amendment itself empowered them to do.
In summary, in a democracy, a clause of this type should not be employed unless everyone is certain that it applies. Yet, almost daily there is another story about these efforts to remove Trump from the ballot in several States, including Arizona, Colorado, Michigan, Minnesota, New Hampshire, and New York. There certainly will be many others, especially if any entity succeeds in removing him. All of these efforts to restrict the choices of the People in the 2024 Election are being led by Democrats or Democrat affiliated groups. To date, no prominent Democrat has bother to denounce them.
It is hard to imagine something less democratic than preventing the public from voting for the person of their choice. Yet, this is the current position of the Democrat Party.
For those still getting their “news” from the MainStreamMedia, it is plain for all to see that the GOP is “extreme” and Trump is a threat to “democracy.” Indeed, the latest ridiculous narrative being pushed by the “Media” is that Trump plans to be a dictator if elected. Of course, there is no evidence for this absurdity nor even the slight interest in investigating how one could possible because a dictator under the American system. Meanwhile, thought those interested in reality might want to consider that the last couple of weeks provided powerful insights into where the United States actually is headed.
To be perfectly clear, democRATS nEvEr stood for a Democratic Republic. They do, however stand for ‘democracy’, as ‘democracy’ is Mob Rule.
